1. Services

Off & On IT provides general technology support services, including (but not limited to):

  • Troubleshooting hardware and software issues
  • Device setup and configuration
  • Network and internet support
  • General IT advice and assistance

We will take reasonable care and skill in delivering services, in line with New Zealand consumer law.

2. Scope & Limitations

  • We do not guarantee that all issues can be resolved.
  • Some problems may require third-party support (for example: internet providers and software vendors).
  • We are not responsible for faults caused by pre-existing issues, third-party software or services, or customer misuse or changes after service delivery.

3. Bookings & Access

  • Customers must provide safe and reasonable access to equipment and premises.
  • For remote services, customers must ensure a stable internet connection.
  • We reserve the right to refuse or stop work if conditions are unsafe or inappropriate.

4. Pricing & Payment

  • Pricing will be agreed in advance (hourly or fixed fee).
  • A call-out fee may apply for onsite visits.
  • Payment is due within 7 days of invoice unless otherwise agreed.
  • Late payments may incur reasonable collection costs.

5. Cancellations & Rescheduling

  • Please provide at least 24 hours notice for cancellations.
  • Late cancellations may incur a fee.

6. Data & Backups

  • Customers are responsible for backing up their data before services are performed.
  • While we take care, data loss is a known risk during IT work.
  • Off & On IT is not responsible for loss of data unless required by law.

7. Liability

To the maximum extent permitted by law:

  • Our liability is limited to the amount paid for the services provided.
  • We are not liable for indirect or consequential loss (for example: loss of business, income, or data).

Nothing in this clause limits your rights under New Zealand consumer law.

8. Consumer vs Business Clients

  • If you are a consumer, your rights under the Consumer Guarantees Act apply and cannot be excluded.
  • If you are acquiring services for business purposes, and both parties agree, the Consumer Guarantees Act will not apply, to the extent permitted by law.

9. Third-Party Products & Services

  • We may recommend or assist with third-party products or services.
  • We are not responsible for their performance, reliability, or ongoing support.

10. Warranties & Guarantees

  • We provide services with reasonable care and skill, as required by New Zealand law.
  • No additional warranties are provided unless explicitly stated.

11. Health & Safety

  • Customers must ensure a safe working environment.
  • We may refuse to continue work if safety risks are identified.

12. Privacy

  • We may collect and use personal information only as necessary to provide services.
  • We will handle personal information in accordance with New Zealand privacy law.

13. Changes to Terms

We may update these Terms from time to time. The latest version will be available on our website.

14. Governing Law

These Terms are governed by the laws of New Zealand.

By engaging Off & On IT, you agree to these Terms of Service. These Terms are available on our website and may be referenced in quotes and invoices.
